VERIX LABS (“we,” “us,” or “our”) is committed to handling “Consumer Health Data” responsibly. This Consumer Health Data Privacy Policy supplements our main Privacy Policy and explains our practices specifically for Consumer Health Data, as defined by the Washington My Health My Data Act (MHMDA) and similar state laws that may apply to Users located in those states.

THIS POLICY APPLIES IN ADDITION TO, NOT INSTEAD OF, OUR PRIVACY POLICY. WHERE THIS POLICY GIVES YOU ADDITIONAL OR MORE SPECIFIC RIGHTS REGARDING CONSUMER HEALTH DATA, THIS POLICY CONTROLS FOR THAT DATA.

1. WHAT IS “CONSUMER HEALTH DATA”?

1.1 Under the Washington My Health My Data Act, “Consumer Health Data” generally means personal information that is linked, or reasonably linkable, to you and that identifies your past, present, or future physical or mental health status. This can include non-medical information, such as precise location data that could reveal an attempt to obtain health care, reproductive or sexual health information, and gender-affirming care information.

1.2 ComeAround is a dating and hangout platform, not a health service. We do not intentionally collect Consumer Health Data as part of core account creation. However, because Users can share information freely in their profile, bio, and messages, and because the Service uses location features, certain information you choose to share, or certain location data we collect with your permission, may qualify as Consumer Health Data under this law.

2. CATEGORIES OF CONSUMER HEALTH DATA WE MAY COLLECT

We only collect the following categories of Consumer Health Data to the extent you choose to provide it, or as described below:

3. SOURCES OF CONSUMER HEALTH DATA

3.1 We may receive Consumer Health Data from the following sources:

  • Directly from you, if you choose to include it in your profile, bio, or messages;
  • From your device, if you grant location permissions used for nearby matching, live location, or “Available Now”, as described in our Privacy Policy;
  • From you or another User, in the context of a safety report or a block; and
  • From your communications with our support team, if you contact us for assistance and choose to share health-related context.

4. HOW WE USE CONSUMER HEALTH DATA

4.1 We use Consumer Health Data only to: (a) operate the specific feature through which you provided it, such as displaying your profile or bio to other Users, or powering location-based features; (b) investigate and respond to safety reports; (c) maintain the security and integrity of the Service; and (d) comply with applicable law.

4.2 We do not use Consumer Health Data to make decisions about your eligibility for health care, insurance, employment, or similar services, and we do not use it for advertising.

5. HOW WE DISCLOSE CONSUMER HEALTH DATA

5.1 We may disclose Consumer Health Data to:

  • Our service providers (such as our backend and database provider, Supabase) who process it on our behalf, solely to help us operate the Service;
  • Law enforcement or other parties, where necessary to comply with a legal obligation, protect against fraud or security threats, or protect the safety of a User or the public; and
  • An acquiring party, in the event of a merger, acquisition, or sale of assets, subject to this Policy or a successor policy.

5.2 Other than as described above, we do not share Consumer Health Data with third parties, and we do not share it with unaffiliated companies for their own independent purposes.

6. WE DO NOT SELL CONSUMER HEALTH DATA

WE DO NOT, AND WILL NOT, SELL YOUR CONSUMER HEALTH DATA. WE DO NOT DISCLOSE CONSUMER HEALTH DATA TO THIRD PARTIES IN EXCHANGE FOR MONETARY OR OTHER VALUABLE CONSIDERATION, EXCEPT AS OTHERWISE DESCRIBED IN THIS POLICY OR AS PERMITTED WITH YOUR VALID AUTHORIZATION UNDER APPLICABLE LAW.

7. NO GEOFENCING AROUND HEALTH CARE FACILITIES

7.1 We do not use geofencing technology around any mental health facility, reproductive or sexual health facility, or other health care facility to identify, track, collect data from, or send notifications or advertisements to Users who visit such locations, as prohibited by the Washington My Health My Data Act.

8. YOUR PRIVACY RIGHTS FOR CONSUMER HEALTH DATA

8.1 If you are located in Washington State, or another state with a comparable consumer health data law, you have the right to:

  • Know and access the specific categories of Consumer Health Data we have collected about you, and the categories of sources, affiliates, and third parties with whom it has been shared;
  • Withdraw your consent to our collection or use of your Consumer Health Data, to the extent we rely on consent;
  • Request deletion of your Consumer Health Data; and
  • Not be discriminated against for exercising any of these rights.

8.2 Because much of the information described in Section 2 is information you voluntarily included in your profile or messages, the simplest way to exercise many of these rights is to edit or delete that content directly, or to delete your Account, as described in our Privacy Policy.

9. HOW TO EXERCISE YOUR RIGHTS

9.1 To submit a request regarding your Consumer Health Data, contact us at support@comearound.app. We will take reasonable steps to verify your identity before responding, and we will respond within forty-five (45) days, which may be extended once by an additional forty-five (45) days where reasonably necessary.

9.2 If we decline your request, you may appeal by replying to our decision at the same email address. If your appeal is denied, you may file a complaint with the Washington State Attorney General at atg.wa.gov, or with the attorney general of another applicable state.

10. CHANGES TO THIS POLICY

10.1 We may update this Policy from time to time. If we make material changes, we will update the “Effective Date” on the cover page and, where required by applicable law, provide additional notice.
