TERMS OF USE

PLEASE READ THESE TERMS CAREFULLY. BY CREATING AN ACCOUNT, DOWNLOADING, ACCESSING, OR USING THE APP, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICE.
Section 28 contains a Release of Liability for offline interactions. Section 35 explains how disputes are resolved, including arbitration and a class action waiver for U.S. Users. Section 24 links to our Safety Center. Please read all three carefully.
1. DEFINITIONS
"Account" means the personal profile and credentials you create to access and use the Service.
"App" or “Service” means the ComeAround mobile application and website located at www.comearound.app, together with all related features, content, and functionality.
"Available Now" means an optional status a User may activate to indicate they are available to meet with nearby Users within a short timeframe, as described in Section 17.
"Group Meetup" means an event created within the Service intended for three (3) or more Users to attend together, as described in Section 18.
"Match" means a mutual connection formed when two Users each indicate interest in the other through the Service.
"Premium Services" means any paid subscription plan, one-time purchase, or premium feature offered within the Service.
"User Content" means any text, photographs, video, audio, or other material submitted, posted, or transmitted by a User through the Service.
"User" “you,” or “your” means an individual who has created an Account and is authorized to access the Service.
"VERIX LABS" “we,” “us,” or “our” means VERIX LABS, the business that develops and operates the Service, which can be reached at support@comearound.app.
2. ACCEPTANCE OF THESE TERMS
2.1 These Terms of Use (“Terms”) form a legally binding agreement between you and VERIX LABS governing your access to and use of the Service. By creating an Account or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy.
2.2 If you do not agree to these Terms, you must not access or use the Service.
3. ELIGIBILITY
3.1 You must be at least 18 years old to create an Account or use the Service. ComeAround is not directed to, and must not be used by, anyone under the age of 18, regardless of the age of majority in your jurisdiction.
3.2 By using the Service, you represent and warrant that: (a) you are at least 18 years old; (b) you have the legal capacity to enter into a binding contract; (c) you are not prohibited from using the Service under any applicable law; (d) you have not been convicted of, or pleaded no contest to, a felony, a sex crime, or any crime involving violence, and are not required to register as a sex offender in any jurisdiction; and (e) you will comply with these Terms.
3.3 We may use age and identity verification tools, including third-party verification providers, to help confirm your eligibility, and may suspend or terminate any Account that cannot be verified or that we reasonably believe belongs to a person under 18.
4. ABOUT COMEAROUND
4.1 ComeAround is a social discovery platform that allows Users to create profiles, browse and match with other Users, exchange messages, and arrange in-person or virtual hangouts and dates, including one-on-one meetings and Group Meetups.
4.2 The Service is a venue through which Users may meet one another. We do not organize, supervise, or participate in any meeting, hangout, or Group Meetup arranged between Users, and we have no control over the conduct of any User, on or off the Service.
4.3 We may add, modify, suspend, or discontinue any feature of the Service at any time, with or without notice, and without liability to you.
5. USER ACCOUNTS
5.1 To use the Service, you must create an Account and provide accurate, current, and complete information, which may include your name, date of birth, email address, phone number, photographs, and other profile details.
5.2 You may not: create more than one Account; create an Account on behalf of another person; or create an Account if you are under 18.
5.3 We reserve the right to refuse registration, or to suspend or terminate any Account, at our sole discretion, including where we believe the information provided is false, misleading, or incomplete.
6. ACCOUNT SECURITY
6.1 You are solely responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your Account.
6.2 Notify us immediately at support@comearound.app if you become aware of any unauthorized access to, or use of, your Account.
6.3 We are not liable for any loss or damage arising from your failure to safeguard your Account credentials.
7. USER VERIFICATION
7.1 We may offer or require identity verification (such as a government-issued ID) and/or photo verification (such as a real-time selfie compared against your profile photos) to help confirm that you are a real person and that your profile accurately represents you.
7.2 A verification badge or status indicates only that you completed the applicable verification step at a point in time. It is not, and must not be relied upon as, confirmation of a User’s character, intentions, or safety. See Section 26 (Background Verification Disclaimer).
7.3 Attempting to circumvent, falsify, or manipulate any verification process — including by using another person’s photo or identification — is a serious violation of these Terms and may result in immediate Account termination and, where appropriate, a report to law enforcement.
8. USER RESPONSIBILITIES
8.1 You are responsible for your Account, your User Content, your interactions with other Users, and your compliance with these Terms and all applicable laws.
8.2 You agree to provide accurate information in your profile and to keep it up to date, and not to misrepresent your identity, age, marital status, or intentions.
8.3 You are solely responsible for evaluating the suitability of any User you interact with and for exercising appropriate caution, as described in Section 26 (Safety Disclaimer).
9. COMMUNITY STANDARDS
9.1 ComeAround is built on respectful, honest interaction. You agree to treat other Users courteously, communicate honestly, and respect the boundaries and preferences of others.
9.2 We may publish supplemental community guidelines from time to time, which are incorporated into these Terms by reference. We reserve the right to remove content or restrict Accounts that fall short of these standards, even where the conduct does not rise to the level described in Section 10 (Prohibited Activities).
10. PROHIBITED ACTIVITIES
10.1 You agree that you will not:
- Harass, threaten, stalk, defame, or intimidate any person;
- Post or transmit content that is unlawful, hateful, discriminatory, sexually explicit, or exploitative, particularly content involving minors;
- Impersonate any person or entity, or misrepresent your identity, age, or affiliation;
- Solicit money, gifts, loans, or financial or banking information from another User, or otherwise engage in romance scams or “catfishing”;
- Use the Service for commercial solicitation, advertising, or unauthorized promotion;
- Upload content that infringes any third party’s intellectual property or privacy rights;
- Use bots, scripts, scrapers, or other automated means to access or extract data from the Service;
- Reverse-engineer, decompile, or attempt to extract the source code of the App;
- Circumvent or interfere with any security, verification, or access-control feature of the Service, including live location or “Available Now” features; or
- Violate any applicable law or regulation.
10.2 We reserve the right, but have no obligation, to monitor, review, remove, or restrict access to content and Accounts that we believe violate these Terms, applicable law, or our community guidelines, without prior notice and at our sole discretion.
10.3 You may report other Users or content you believe violates these Terms using the in-app reporting tools or by contacting support@comearound.app.
11. USER GENERATED CONTENT
11.1 You retain ownership of your User Content. By submitting User Content, you grant VERIX LABS a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, adapt, and distribute your User Content solely for the purposes of operating, providing, promoting, and improving the Service.
11.2 You represent and warrant that you own or otherwise control all rights to your User Content and that it does not violate the rights of any third party or any applicable law.
11.3 Your public profile information will be visible to other Users as part of the core functionality of the App. Do not post sensitive personal information — such as your home address, financial details, or government identification numbers — in your public profile.
11.4 We reserve the right to remove any User Content at our discretion, without notice, including content that violates these Terms.
12. INTELLECTUAL PROPERTY
12.1 The Service, including its design, text, graphics, logos, the “ComeAround” name and marks, software, and all related content (excluding User Content), is owned by or licensed to VERIX LABS and is protected by copyright, trademark, and other intellectual property laws.
12.2 Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use.
12.3 You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on the Service, in whole or in part, except as expressly permitted by us in writing.
13. COPYRIGHT COMPLAINTS (DMCA NOTICE)
13.1 We respect the intellectual property rights of others and expect Users to do the same. If you believe content on the Service infringes your copyright, you may submit a notice to our designated agent at support@comearound.app (marked “Copyright Notice”) including: (a) your signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its location on the Service; (d) your contact information; (e) a statement that you have a good-faith belief the use is unauthorized; and (f) a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act on behalf of the copyright owner.
13.2 We may remove or disable access to material identified in a valid notice, and may terminate the Accounts of repeat infringers, in accordance with applicable law, including the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512, where applicable.
13.3 If you believe your content was removed in error, you may submit a counter-notice with the information required by applicable law, and we will process it accordingly.
14. AI FEATURES
14.1 ComeAround does not currently use artificial intelligence to generate matches, conversation prompts, or other content. We reserve the right to introduce AI-assisted features in the future, such as algorithmic match ranking, automated content moderation, or AI-generated conversation starters.
14.2 If we introduce AI-assisted features, we will update these Terms and, where required by applicable law, provide additional notice. Any AI-assisted feature is provided as a tool to assist you and does not guarantee compatibility, accuracy, or any particular outcome. You remain solely responsible for decisions you make in reliance on any such feature.
15. MESSAGING SERVICES
15.1 The Service may allow Users who have Matched to exchange text messages, photographs, and other content through in-app messaging (“Messaging Services”).
15.2 Messaging Services must be used in accordance with Section 10 (Prohibited Activities). Do not use Messaging Services to send unsolicited commercial content, malicious links, or content that violates these Terms.
15.3 We may monitor, retain, and review messages sent through the Service to enforce these Terms, ensure User safety, investigate reports, or comply with applicable law, subject to our Privacy Policy.
16. LOCATION SERVICES
16.1 Certain features of the Service, such as showing nearby Users, rely on location data collected through your device’s location services with your permission.
16.2 You may disable location permissions in your device settings at any time, though doing so may limit or disable certain features of the Service, including live location and “Available Now.”
16.3 Location data is processed by our service providers, including our backend infrastructure and database providers. Our collection, use, and storage of location data will be described in our Privacy Policy, to be published separately.
17. LIVE LOCATION AND “AVAILABLE NOW”
17.1 Live Location. Certain features may display your approximate real-time location to other Users while those features are active — for example, while browsing nearby Users or during an active Group Meetup. You may enable or disable live location sharing at any time in the App settings, except where continued sharing is necessary for an in-progress safety or Group Meetup session.
17.2 “Available Now.” The Service may allow you to indicate that you are available to meet within a short timeframe. Activating this status may share your approximate location and availability with nearby Users for a limited period. This status is entirely voluntary, and you may deactivate it at any time.
17.3 Sharing your live location or activating “Available Now” increases the visibility of your real-time whereabouts to other Users. You acknowledge this inherent risk and agree to use these features at your own discretion, consistent with the safety guidance in Section 26 (Safety Disclaimer).
18. GROUP MEETUPS
18.1 The Service may allow Users to create or join Group Meetups intended for three or more Users.
18.2 A User who creates a Group Meetup is solely responsible for the details, safety, and conduct of that event. VERIX LABS does not organize, host, supervise, vet attendees for, or guarantee attendance at any Group Meetup.
18.3 We reserve the right to remove any Group Meetup listing that violates these Terms.
18.4 The safety guidance in Section 26 and the release in Section 28 apply equally to Group Meetups.
19. NO GUARANTEE OF MATCHES
19.1 ComeAround does not guarantee that you will be matched with any User, that any Match will result in communication, a meeting, or a relationship, or that any Match, message, or introduction will meet your expectations.
19.2 Any compatibility indicators, rankings, or suggestions provided within the Service are for informational purposes only and are not a guarantee of compatibility, safety, or outcome.
20. PREMIUM SERVICES
20.1 ComeAround offers free and paid features, including subscription plans and one-time purchases (“Premium Services”). Available plans, pricing, and included features will be presented to you in the App before purchase.
21. PAYMENTS
21.1 Payment will be charged to your selected payment method, or your Apple ID or Google Play account where applicable, at the time of purchase and again at the start of each renewal period.
21.2 Applicable taxes will be added to the listed price where required by law.
21.3 You are responsible for keeping your payment information current. We are not liable for any loss of access to Premium Services resulting from an expired or declined payment method.
22. AUTOMATIC RENEWAL
22.1 Subscriptions automatically renew for successive periods equal to the term you originally selected (for example, monthly, quarterly, or annually), at the then-current price, unless you cancel before the end of the current billing period.
22.2 You may cancel auto-renewal at any time through your device’s app store account settings (App Store or Google Play), or, for purchases made directly through the Service, via your Account settings or by contacting support@comearound.app. Cancellation takes effect at the end of the current billing period, and you will retain access to Premium Services until then.
22.3 We may change subscription pricing at any time. If we increase the price of a subscription you are enrolled in, we will provide advance notice, and the new price will take effect at your next renewal unless you cancel beforehand.
23. REFUNDS
23.1 Except where required by applicable law, all payments are non-refundable, and we do not provide refunds or credits for partial subscription periods, unused features, or downgrades.
23.2 Purchases made through the Apple App Store or Google Play Store are additionally subject to those platforms’ respective refund policies, which are administered by Apple or Google, not VERIX LABS.
23.3 California Users — Right to Cancel
23.3 If you are a California resident, you have the right to cancel a purchase of Premium Services within three (3) business days of the transaction, for a full refund, as required by the California Dating Service Contracts law (Cal. Civ. Code §§ 1694–1694.4). To cancel within this period, contact us at support@comearound.app.
23.4 If you are a California resident and become unable to use Premium Services due to death or disability, you or your estate may cancel your subscription and receive a refund of the prepaid amount attributable to services not yet received.
23.5 This Section 23.3 and 23.4 apply only to California residents and only to the extent required by California law; Section 23.1 continues to apply in all other respects.
24. SAFETY AWARENESS INFORMATION AND REPORTING
24.1 We maintain a Safety Center, available at www.comearound.app and linked within the App, which provides dating and hangout safety awareness information, including guidance on meeting in person, recognizing scams, and using location features safely.
24.2 You can report concerns about another User’s behavior at any time using the in-app reporting tools or by contacting support@comearound.app, as described in Section 10.3 and in our Community Guidelines.
25. THIRD-PARTY SERVICES
25.1 The Service may link to, or integrate with, third-party websites, services, or content — including payment processors and identity verification providers — that are not owned or controlled by VERIX LABS. We are not responsible for the content, policies, or practices of any third party, and your use of third-party services is at your own risk.
26. SAFETY DISCLAIMER
26.1 ComeAround provides tools intended to help you connect with others, including the verification features described in Section 7. However, no verification, moderation, or safety feature can guarantee the identity, intentions, or safety of any User.
26.2 YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS, ONLINE AND IN PERSON. We strongly encourage you to exercise caution, including by:
- Never sending money, gifts, or financial or banking information to anyone you meet through the Service;
- Meeting for the first time in a public place, including for Group Meetups;
- Telling a friend or family member where you are going and who you are meeting;
- Withholding sensitive personal information, such as your home address or workplace, until you are confident in the person;
- Using caution before enabling live location or “Available Now” with Users you do not know well; and
- Trusting your instincts and leaving any situation that makes you feel unsafe.
26.3 If you believe you are in immediate danger, contact your local emergency services. To report suspicious, abusive, or unlawful conduct on the Service, contact support@comearound.app.
27. BACKGROUND VERIFICATION DISCLAIMER
27.1 VERIX LABS does not currently conduct criminal background checks, sex-offender registry searches, or similar screening on Users, unless expressly stated otherwise within the App for a specific feature.
27.2 Identity and photo verification, described in Section 7, confirm only that a User completed the applicable verification step; they are not, and must not be treated as, a background check, and do not confirm that a User has no criminal history or poses no risk.
27.3 If we introduce background-check features in the future, their scope and limitations will be disclosed within the App at that time.
28. OFFLINE MEETINGS AND RELEASE OF LIABILITY
28.1 The Service may facilitate connections that lead to meetings outside the App, including one-on-one dates, hangouts, and Group Meetups (“Offline Meetings”). VERIX LABS does not organize, supervise, or participate in any Offline Meeting.
28.2 You are solely responsible for your own safety and conduct at any Offline Meeting, and for exercising the precautions described in Section 26 (Safety Disclaimer).
RELEASE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE VERIX LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, OR LIABILITIES OF ANY KIND, KNOWN OR UNKNOWN, ARISING OUT OF OR IN CONNECTION WITH YOUR INTERACTIONS WITH OTHER USERS, WHETHER ONLINE OR IN PERSON, INCLUDING ANY OFFLINE MEETING OR GROUP MEETUP. THIS RELEASE DOES NOT APPLY TO ANY LIABILITY THAT CANNOT LAWFULLY BE RELEASED, INCLUDING LIABILITY ARISING FROM VERIX LABS’ OWN GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
28.3 If you are a California resident, you expressly waive California Civil Code Section 1542, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, which, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” Residents of other jurisdictions waive any comparable protection available under the laws of their jurisdiction of residence, to the extent permitted by law.
29. ACCOUNT SUSPENSION
29.1 We may temporarily suspend your Account or restrict access to certain features, with or without notice, while we investigate a suspected violation of these Terms, a User report, or unusual or potentially fraudulent activity.
29.2 We will aim to resolve suspensions promptly and may reinstate your Account once the matter is resolved, at our discretion.
30. ACCOUNT TERMINATION
30.1 You may delete your Account at any time through the App settings or by contacting support@comearound.app.
30.2 We may terminate your Account or access to the Service at any time, with or without notice, if we determine you have violated these Terms, engaged in fraudulent or unlawful conduct, or for any other reason at our sole discretion, including to protect the safety of our Users or the integrity of the Service.
30.3 Upon termination, your right to use the Service will immediately cease, and we are not obligated to issue any refund for Premium Services. Provisions that by their nature should survive termination — including Sections 11.1, 13, 23, 24, 28, 31, 32, 33, 34, 35, 36, and 37 — will continue to apply.
31. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE THAT ANY USER IS WHO THEY CLAIM TO BE, AND WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, ONLINE OR OFFLINE.
31.1 Some jurisdictions do not permit the exclusion of certain warranties, so some of the exclusions above may not apply to you.
32. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VERIX LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR THE CONDUCT OF ANY USER, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
32.1 To the maximum extent permitted by applicable law, VERIX LABS’ total aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the greater of: (a) the amount you paid to VERIX LABS in the twelve (12) months preceding the event giving rise to the claim; or (b) CAD $100 (or the U.S.-dollar equivalent for U.S. Users).
32.2 Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence.
33. INDEMNIFICATION
33.1 You agree to indemnify, defend, and hold harmless VERIX LABS and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or the rights of any third party; or (e) your interactions with other Users, whether online or in person, including at any Offline Meeting or Group Meetup.
34. GOVERNING LAW
34.1 These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles, regardless of your country of residence, except to the extent mandatory consumer protection laws of your jurisdiction of residence apply and cannot be waived.
35. DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER
35.1 Informal Resolution
35.1 Before filing a claim, you agree to first contact us at support@comearound.app and attempt, in good faith, to resolve the dispute informally for at least thirty (30) days.
35.2 Users Located in Canada
35.2 If you are located in Canada, any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts of the Province of Ontario, and each party consents to the personal jurisdiction of such courts. Nothing in this Section restricts any right you have under Canadian consumer protection law, including the Ontario Consumer Protection Act, 2002, which does not permit mandatory arbitration or class action waivers to be enforced against consumers. Arbitration and the class action waiver in Sections 35.3 and 34.4 accordingly do not apply to you.
35.3 Users Located in the United States — Binding Arbitration
35.3 If you are located in the United States, you and VERIX LABS agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration administered by a recognized arbitration provider (such as JAMS or the American Arbitration Association) under its applicable rules, rather than in court, except that either party may bring an individual claim in small claims court where eligible.
35.4 Class Action Waiver (U.S. Users)
35.4 To the extent permitted by applicable law, you and VERIX LABS agree that any arbitration or legal proceeding will be conducted only on an individual basis, and not as a class, consolidated, or representative action. If this class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court rather than in arbitration, and the remainder of this Section will remain in effect.
35.5 Opt-Out
35.5 If Section 35.3 applies to you, you may opt out of binding arbitration by sending written notice to support@comearound.app within thirty (30) days of first accepting these Terms, identifying your name and Account email. If you opt out, disputes will instead be resolved in accordance with Section 34 (Governing Law).
36. MOBILE APPLICATION / APP STORE TERMS
36.1 If you access the Service through the Apple App Store, the following additional terms apply, and this Section governs solely with respect to Apple in the event of any conflict: (a) VERIX LABS grants you a non-transferable license to use the App on any Apple-branded product you own or control, as permitted by the App Store’s usage rules; (b) VERIX LABS, not Apple, is solely responsible for the App and its content and for providing any maintenance and support required under these Terms; (c) in the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the applicable purchase price, if any, and, to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App; (d) VERIX LABS, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, and consumer protection claims; (e) VERIX LABS, not Apple, is responsible for investigating, defending, and resolving any claim that the App infringes a third party’s intellectual property rights; (f) you represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties; and (g) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as such.
36.2 If you access the Service through the Google Play Store, your use is additionally subject to the Google Play Terms of Service, which govern solely with respect to Google in the event of any conflict specific to that platform.
36.3 You are also responsible for complying with any other applicable third-party terms, such as your wireless carrier’s agreement, when using the Service on a mobile device.
37. GENERAL PROVISIONS
37.1 Entire Agreement. These Terms, together with our Privacy Policy (once published) and any additional terms referenced herein, constitute the entire agreement between you and VERIX LABS regarding the Service.
37.2 Severability. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
37.3 No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
37.4 Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, financing, or sale of assets.
37.5 Force Majeure. We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control.
37.6 Electronic Communications. You consent to receive communications from us electronically, including by email, push notification, or posting within the App, and agree that such communications satisfy any legal requirement that they be in writing.
37.7 Notices. We may provide notices to you by email, through the App, or by posting on our website. Notices to us should be sent to support@comearound.app.
38. CHANGES TO THESE TERMS
38.1 We may modify these Terms from time to time. If we make material changes, we will update the “Effective Date” on the cover page and, where required by law, provide additional notice, such as an in-app notice or an email.
38.2 Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may delete your Account.
